Discretion and Ethical Decisions week 2 discussion 2
Citizens truly do not want officers who fail to take circumstances into account to apply discretion. If this were the case, everyone would always get a ticket no matter what the situation. Is it fair, for instance, to ticket a man driving 10 mph over the speed limit because he is taking his wife, who is delivering a baby, to the hospital that is a mile away? I think most officers wouldn’t hesitate to forgo the ticket in this situation. Discretion is difficult to explain, but a necessary aspect of policing. Kleinig looks at this deeper in his text here: http://bit.ly/1BiFFGC
What other situations would you most likely use discretion to not strictly enforce the law? Good comments on the topic in your answer.
